Welcome to Effectiv Media LLC. These terms and conditions govern the use of our services and establish the rights and responsibilities of both parties. By engaging with our services, you agree to comply with these terms. Please read them carefully.
Effectiv Media LLC provides video production, marketing strategy, website design, branding, photography, and CRM automation services. Specific services will be detailed in the contract signed by both parties.
Initial Consultation: We’ll discuss the scope of the project and required services.
Proposal and Contract: A detailed proposal, including timelines, deliverables, and costs, will be provided. Acceptance and Payments: A 50% upfront deposit is required to start the project. The remaining balance (50%) is due upon project completion or can be split into negotiated payment installments.
Provide all necessary information and materials required for the project in a timely manner. Respond to approval and feedback requests within 48 hours or less. Adhere to the payment terms outlined in the contract.
Deliverables will be specified in the project contract. Deadlines depend on client collaboration and payment compliance. Requests for additional changes outside the original project scope will incur additional charges.
Rights to use videos, images, and other content produced by Effectiv Media LLC will be transferred to the client upon receipt of full payment. Effectiv Media LLC retains the right to use completed projects for marketing, portfolio display, or as stock footage unless otherwise agreed in writing.
Payment Terms: 50% upfront deposit, with the remaining balance due at completion or as negotiated. Refund Policy: Refunds are only available under specific circumstances, such as unforeseen events outside of either party’s control.
Effectiv Media LLC will protect all confidential information provided by the client and will not share it with third parties without prior consent unless required for the project’s execution.
Effectiv Media LLC will not be held responsible for:
Unforeseen results beyond its control, such as changes to social media or search engine algorithms. Delays caused by lack of client cooperation. Financial losses or indirect damages resulting from the use of its services.
Effectiv Media LLC prioritizes resolving disputes amicably.
Negotiation and Mediation: Both parties agree to resolve disputes through good-faith negotiation and mediation first. Arbitration: If disputes cannot be resolved through mediation, they will be settled via arbitration under the laws of New Mexico, United States, instead of court proceedings. Arbitration is chosen to save time and costs for both parties.
Clients must provide at least one week’s notice to cancel a project. Effectiv Media LLC reserves the right to bill for work completed up to the cancellation date.
Effectiv Media LLC reserves the right to modify these terms and conditions at any time. Clients will be notified of any significant changes before they take effect.
